Notice of Relevant Procedures for Foreigners Entering China for Completion of Short-Term Work Assignment [《外国人入境完成短期工作任务的相关办理程序(试行)》的通知], Notice No. 78 [2014] of the Ministry of Human Resources and Social Security issued Nov. 6, 2014, effective Jan. 1, 2015.

The procedures to apply for Short-Term Work Visa
(1)Apply for a Employment License
(2)Apply for the invitation letter or invitation confirmation
(3)Apply for a Z visa
(4)Apply for a work-type residence permit

ARTICLE 1.Entry by a foreigner for purposes of a short-term work assignment means entering China for the following reasons for a period of stay not exceeding 90 days:
(1)To complete certain technical, scientific research, management, supervisory, etc. work at a domestic partner’s unit;
(2)To provide training in sports institution in China (including coach, or athlete);
(3)Filming (including advertisements or documentaries);
(4)Fashion shows (including modeling at car shows, shooting print advertisements, etc.);
(5)Engage in foreign-related commercial performances;
(6)Any other circumstances identified by department of Human Resources and Social Security.

ARTICLE 2.The following circumstances will not be considered a short-term work assignment:
(1)Repair, installation, adjustment, disassembly, or giving instructions or training in connection with the purchase of equipment or machinery;
(2)Provide instruction, supervision or inspection to a project in China that has won a bid;
(3)Being dispatched to the branch office, subsidiary or representative office in China to complete a short-term work assignment.
(4)Participation in sports event (including athletes, coaches, team physicians or assistants, or other relevant personnel; the participation in sports events held in China with accreditation cards approved by competent departments of China according to the request of international sports organizations shall be excluded);
(5)Entering China to engage in work without compensation, or to perform work as a volunteer, etc., receiving payment from a foreign organization;
(6)The relevant cultural department has issued an approval document but it does not include an annotation stating, “foreign-related commercial performances”;
In circumstances (1), (2), (3) or (4), where the stay in China will not exceed 90 days, the foreigner should apply for an M visa; in circumstances (5) or (6), where the stay in China will not exceed 90 days, the foreigner shall apply for an F visa.

ARTICLE 3.Foreigners entering China for purposes specified in Article1, or in paragraphs (1), (2), (3) or (5) of Article 2, for a period of stay over 90 days, shall follow the relevant procedures of Regulations of Foreigners’ Employment in China. Those entering China for seasonal labor or short-term labor shall follow relevant regulations.

ARTICLE 4. Foreign art performance groups or individuals entering China for short-term commercial performances shall obtain the Approval Document issued by the culture administrative department and the Approval of Short-Term Employment (hereinafter referred to as “Approval”); Foreigners entering China for completion of other short-term work assignments, shall obtain an Alien Employment License (hereinafter referred to as “License”) issued by the department of Human Resource and Social Security and the Approval.
The registration items indication on the Approval shall include: holder’s nationality, name, work content, place and duration of work, date of issuance etc.

ARTICLE 5.Foreigners applying for entry to China for a short-term assignment shall provide the following documents:
1.Applicant’s valid passport of other international travel document (copies);
2.Resume of the foreigner intending to come to China;
3.Foreigners applying to engage in professional and technical work assignments shall provide related degree or technical (professional) qualification certificates required by Chinese regulations.
4.Co-operation agreement or project contract between China and the foreign party;
5.Applicant’s original Registration Form of Temporary Residence;
6.Applicant’s 2 passport size photos
7.Domestic partner’s registration certificate and organizational code certificate and Approval Certificate (if Foreign invested company) (copies);
8.Other evidence required by the examining and approving authority.
Foreigners entering China for completion of a work assignment at workplaces in two or more provincial-level areas shall apply to the department of Human Resources and Social Security with jurisdiction over the domestic partner’s location.
